The Territory, ACT Education Directorate

Between 2016 and 2017 incidents occurred at three Australian Capital Territory schools run by the ACT Education Directorate involving students causing injuries to teachers.

It was alleged by the regulator that the Australian Capital Territory through the Education Directorate had a health and safety duty pursuant to section 19 of the Work Health and Safety Act 2011 (the Act) do all that was reasonably practicable to ensure the health and safety of its staff and it failed to comply with that duty, therefore exposing its staff to a risk of injury and actual injuries.

The regulator considered a proposal for a work, health and safety undertaking from the Australian Capital Territory through the Education Directorate. The proposal met the regulator’s requirements as outlined in WorkSafe ACT enforceable undertaking publications. The proposal will deliver safety benefits to teachers, students and to the community.
