Glade Group Pty Ltd

On 12 May 2017 Glade Group was advised by a client that they had works coming up at a residential property and asbestos removal would likely be required. Glade Group subsequently undertook friable asbestos removal (lagging) work from a bathroom at the residential property on 3 July 2017 during which time a licensed asbestos assessor undertook background air monitoring, a visual clearance inspection and clearance air monitoring.

On 4 July 2017, Glade Group was advised by the client that a minor amount of lagging had been identified during the removal of the concrete floor in the bathroom. The owner of the residential property subsequently made a compliant regarding the removal process.

It is alleged by WorkSafe ACT that in July 2017 Glade Group Pty Ltd did not comply with section 33 of the Work Health and Safety Act 2011 (the Act) and the asbestos removal works at the residential property was not undertaken in strict accordance with the Glade Group’s Asbestos Removal Control Plan.

The regulator considered a proposal for a work health and safety enforceable undertaking from Glade Group Pty Ltd. The proposal met the regulator’s general guidelines for the acceptance of WHS undertakings under the Act, and was consistent with WorkSafe ACT’s published guidance material for enforceable undertakings.

The proposal was accepted and became an enforceable undertaking on 3 June 2019. The undertaking will deliver safety benefits to workers, to the construction industry and the community. The undertaking included a statement of regret, that Glade Group Pty Ltd acknowledges the seriousness of the incident and injuries sustained by the injured worker and the ongoing and longer-term consequences of the injury.

The total financial commitment of the undertaking is $90,000 - $95,000.

The undertaking requires Glade Group Pty Ltd to:

  • engage contractor to undertake review and additional audits of Safety Systems;
  • provide training to employees in conduct Asbestos Assessments Associated with Removal CPCCBC5014A;
  • provide free face fit testing for industry once a month for a period of 18 months;
  • deliver a benefit to industryto engage a third party to provide assistance with Work Health and Safety advice and job specific audits to ensure continuous improvement throughout the company;
  • donate to Mens Link the amount of $6,000 in the 2019/2020 financial year and $4,000 in the 2020/2021 financial year; and
  • donate to the Ricky Stuart Foundation the amount of $4,500 in the 2019/2020 financial year and $5,500 in the 2020/2021 financial year.
