Who needs workers' compensation insurance

An employer in the ACT must have a workers’ compensation insurance policy to cover their workers, and they must display their insurance company’s return to work program where workers can access it.

Workers’ compensation is separate insurance and is not covered under business and public liability insurance.

Any employers who do not hold a current workers’ compensation policy may be issued with an on-the-spot fine (infringement notice) by WorkSafe ACT inspectors of $7,500.

In addition to an on-the-spot fine, employers are liable to pay up to double the amount avoided in unpaid workers’ compensation insurance premiums as determined by Worksafe ACT.
