Labour Regulation Acts Administered
WorkSafe ACT is the government agency responsible in the ACT for the administration of several Acts that provide workers with minimum conditions of service provisions involving annual leave, long service leave, and parental leave. These are:
Annual Leave
Entitlements to annual leave under the Annual Leave Act 1973 are affected by the Commonwealth's Workplace Relations Act 1996. Information on entitlements under the workplace relations system is available at www.workplaceauthority.gov.au.
Long Service Leave
Three separate government agencies govern the long service leave schemes in the ACT.
WorkSafe ACT
WorkSafe ACT administers the Long Service Leave Act 1976. The Act covers employees in the ACT private sector who are not covered by an industrial award or agreement, or in some cases, where an award or agreement does not contain provisions for long service leave. The Act may also exclude workers that are employed in the cleaning and construction industry.

If you are not employed by a business under a federal award or agreement, have read our Guidance Note on long service leave, and feel you have an entitlement to long service leave that is not recognised, you may request an authorised person within the Office of Regulatory Services (ORS) to investigate your claim by completing and submitting the following form to ORS.
ACT Long Service Leave Authority
Employees that work in the ACT building and construction industry, cleaning industry, community sector and security industry are usually covered by the Long Service Leave (Portable Schemes) Act 2009 which is administered by the ACT Long Service Leave Authority.

The Fair Work Ombudsman
The Fair Work Ombudsman is an independent statutory office created by the Fair Work Act 2009 to promote harmonious, productive and cooperative workplace relations and ensure compliance with Commonwealth workplace laws.

Parental Leave
Entitlements to parental leave under the Parental Leave (Private Sector Employees) Act 1992 are affected by the Commonwealth's Workplace Relations Act 1996. Information on entitlements under the workplace relations system is available at www.workplaceauthority.gov.au.
